Commonwealth Professor of Business Law Juliet Moringiello is the co-author of a newly released problem method case book, Essential UCC Concepts: A Survey of Commercial Transactions. The book was co-authored by Candace Zierdt and Kristen David Adams, both professors of law at Stetson University.
The publication covers the Uniform Commercial Code articles commonly taught in law schools and is broken down into three sections: sales, payment systems and secured transactions. Moringiello is the author of the secured transactions section of the text.
“The reason we wrote this book is because a lot of states have adopted the Uniform Bar Exam (UBE) and the UBE has more extensive Uniform Commercial Code coverage than some of the other state bars,” said Moringiello. “At schools in states that have the UBE, this book is really helpful for a universal and comprehensive commercial law course.”
She added that the book is one of the few legal texts that is both problem-based and provides comprehensive coverage of both the Uniform Commercial Code and related laws that are used in the practice of commercial law.
“Problem solving is an essential skill for lawyers because no matter what area of law you practice you are solving a problem,” said Moringiello. “An innovation of this book is it focuses a lot on the transactional aspect and gives examples of agreements lawyers enter into. There is also a heavy focus on statutory interpretation because statutory interpretation is an important practice skill regardless of a lawyer’s practice area.”
Moringiello is a well-known scholar and law professor who writes in the areas of bankruptcy, secured credit and electronic commerce. She currently serves as the chair of the Business Law Section of the Pennsylvania Bar Association.
She played a key role in the enactment in Pennsylvania of several revised articles of the Uniform Commercial Code. Moringiello is an elected member of the American Law Institute and the American College of Commercial Finance Lawyers. In 2015, she was appointed as a Uniform Law Commissioner for Pennsylvania.
